The General Administrative Law Act (Algemene wet bestuursrecht, Awb) governs almost every dealing you have with a Dutch public authority: how it must prepare a decision, how long it may take, and how you challenge it. The key rule is that you can object only against a formal decision (besluit), within six weeks after it was sent (Article 6:7 Awb); a special statute, such as the Aliens Act 2000 or the Environment and Planning Act, can deviate from this.

The Awb does not decide whether you get your permit or subsidy; the sector-specific statute does. The Awb sets the procedure and the standards, from the municipality and the Tax Administration to the IND and the ACM. Below we explain the core concepts, the general principles, decision periods and the route of প্রশাসনিক আইন সুরক্ষা.

সুচিপত্র

When does the Awb apply?

The Awb applies to acts of an administrative authority (bestuursorgaan): an organ of a public-law legal person, such as the State, a province, a municipality or a water authority, or any other person or body vested with public authority (Article 1:1 Awb). A foundation or private company can therefore be an administrative authority as far as a statute gives it a public power, for example to certify or to distribute public money.

A special statute takes precedence only where it says something different; everything it leaves untouched remains governed by the Awb. Learn the Awb once and you can find your way in any Dutch regulatory field.

What counts as a decision (besluit)?

A besluit is a written decision of an administrative authority containing a public-law legal act (Article 1:3 Awb). It must be in writing, come from an administrative authority, rest on a public-law power and be intended to create, change or refuse a legal consequence.

Only a besluit opens the route of objection and appeal. An inspector’s remark, an information letter or a warning of what the authority might do are factual acts (feitelijke handelingen) without legal effect; the civil court is the forum for those. A refusal of an application is itself a decision, and a failure to decide in time is equated with one (Article 6:2 Awb). General binding regulations and policy rules cannot be appealed in their own right (Article 8:3 Awb).

What is a beschikking?

A beschikking is a decision that is not of general application, including the refusal of an application for one (Article 1:3(2) Awb). Your permit, subsidy, fine or enforcement order are all beschikkingen, and most of Chapter 4 of the Awb is written for them.

Who is an interested party?

Only an interested party (belanghebbende) may object or appeal: a person whose interest is directly affected by the decision (Article 1:2 Awb). Case law requires an interest that is your own, personal, objectively determinable, current and direct.

A neighbour who can see or hear a planned installation usually qualifies; someone several streets away usually does not. A competitor qualifies against a rival’s permit only if it operates in the same market and area. A legal person may act for collective interests that fall within its objects and that it actually pursues (Article 1:2(3) Awb).

Which general principles of good administration does the court apply?

The general principles of good administration (algemene beginselen van behoorlijk bestuur) are the standards against which courts test decisions. Some are codified in the Awb, some are unwritten; both are binding.

  • যথাযথ যত্ন: the authority gathers the necessary knowledge about the relevant facts and interests (Article 3:2 Awb). A failure to investigate a decisive fact is the most common successful ground.
  • Proper reasons: a decision must rest on sound reasoning (Article 3:46 Awb), stated when it is notified (Article 3:47 Awb).
  • No misuse of power: a power may only be used for the purpose for which it was granted (Article 3:3 Awb).
  • Legal certainty and equality: decisions must be clear, and comparable cases must be treated alike, especially where the authority departs from its own policy.
  • Legitimate expectations: a concrete assurance, attributable to the competent authority, on which you reasonably relied must in principle be honoured. The Administrative Jurisdiction Division of the Council of State set out a three-step test on 29 May 2019 (ECLI:NL:RVS:2019:1694).

How strict is the proportionality test since 2022?

Article 3:4 Awb requires the authority to weigh the interests involved, and the adverse consequences of a decision may not be disproportionate to its aims. In its judgment of 2 February 2022 (ECLI:NL:RVS:2022:285), the Administrative Jurisdiction Division of the কাউন্সিল অফ স্টেট replaced the old “manifestly unreasonable” test with an explicit assessment of suitability, necessity and balance.

How intensively the court reviews depends on the discretion the statute gives, the interests at stake and the severity of the interference. Arguments that a closure, withdrawal or enforcement order goes too far are now worth making. Where the statute leaves the authority no discretion, however, Article 3:4 offers nothing to weigh.

How must a decision be prepared?

Before refusing an application on facts about the applicant that differ from what the applicant supplied, the authority must give the applicant the chance to state its views (Article 4:7 Awb). A similar duty applies to third parties who can be expected to object (Article 4:8 Awb). If the file contains something decisive about you, correct it at that stage.

What is the uniform public preparatory procedure?

For decisions affecting many people, Division 3.4 of the Awb provides a heavier procedure, which applies only where a statute or the authority itself says so (Article 3:10 Awb). The authority publishes a draft decision, and interested parties, or anyone where the statute says so, can submit views (zienswijzen) within six weeks (Article 3:16 Awb).

After this procedure there is no objection stage: you appeal directly to the court. If you submitted no views on the draft, your position on appeal may be weaker, so the decisive moment comes months before the final decision.

How long may the authority take to decide?

The authority must decide within the period set by the applicable statute or, if there is none, within a reasonable period, which in any event ends eight weeks after receipt of the application (Article 4:13 Awb). It may postpone with notice to you, naming a period that is as short as possible (Article 4:14 Awb), and the period is suspended while it waits for information it properly requested (Article 4:15 Awb).

What can you do if the authority decides too late?

Nothing happens automatically. You must first send a written notice of default (ingebrekestelling). Two weeks after the authority receives it, a penalty payment (dwangsom) starts to run for each day of further delay, for at most 42 days (Article 4:17 Awb).

The amounts are €23 per day for the first fourteen days, €35 per day for the next fourteen and €45 per day for the remaining days, so at most €1,442 in total. No penalty is due if you gave notice unreasonably late, are not an interested party, or the application is manifestly inadmissible or unfounded (Article 4:17(5) Awb).

The penalty no longer applies to decisions of the Immigration and Naturalisation Service (IND) on applications under the Aliens Act 2000; it was abolished with effect from 15 April 2025. You can still give notice of default and appeal against the failure to decide.

An appeal against a failure to decide is not bound by a time limit, but you can file it only after the notice of default and two weeks have passed (Article 6:12 Awb). If the appeal succeeds, the court orders the authority to decide within two weeks and attaches a penalty payment to that order (Article 8:55d Awb).

What is the standard route to challenge a decision?

Unless a special statute or the public preparatory procedure says otherwise, you object to the authority that decided, then appeal to the district court, then lodge a higher appeal. The time limit for each step is six weeks (Article 6:7 Awb), starting the day after the decision was sent or published (Article 6:8 Awb).

পর্যায়কোথায়সময় সীমাকি ঘটেছে
আপত্তি (bezwaar)The authority that took the decisionSix weeks after notificationFull reconsideration (Article 7:11 Awb); you are heard (Article 7:2 Awb); decision within six weeks, or twelve with an advisory committee (Article 7:10 Awb)
আপিল (beroep)Administrative law section of the district court (rechtbank)Six weeks after the decision on objectionReview by an independent court; a court fee is payable
উচ্চতর আপিল (hoger beroep)Administrative Jurisdiction Division of the Council of State, Central Appeals Tribunal (CRvB) or Trade and Industry Appeals Tribunal (CBb), depending on the subjectSix weeks after the judgment is sentFinal instance (Articles 8:104 and 8:105 Awb)
অন্তর্বর্তীকালীন ত্রাণপ্রাথমিক প্রতিকার বিচারকWhile objection or appeal is pendingSuspension or another provisional measure if urgency requires (Article 8:81 Awb)

With your request and the authority’s consent, an objection can go directly to the court as an appeal (Article 7:1a Awb). That is worth asking for when the dispute is purely about the law. Tax cases follow their own route via the courts of appeal and the Supreme Court.

What if you miss the six-week deadline?

A late objection or appeal is inadmissible unless you cannot reasonably be blamed for the delay (Article 6:11 Awb). A document sent by post is on time if it was posted before the deadline and received no later than one week after it (Article 6:9 Awb).

The highest administrative courts have made the excusability test somewhat more individual. The CBb did so on 30 January 2024 (ECLI:NL:CBB:2024:31) and the Administrative Jurisdiction Division followed on 3 April 2024 (ECLI:NL:RVS:2024:1406), giving more room to personal circumstances such as illness. Still, the starting point is strict: being abroad or busy is not an excuse. If you cannot yet formulate your grounds, file a short objection in time and ask for time to supplement it (Article 6:6 Awb).

আপত্তি কি সিদ্ধান্ত স্থগিত করে?

No. An objection or appeal does not suspend the effect of the decision (Article 6:16 Awb): a closure stays in force and a fine remains payable. To stop it, apply separately to the preliminary relief judge (Article 8:81 Awb), who looks at urgency, a provisional view of the merits and the balance of interests; a hearing usually follows within days or weeks.

When does the civil court come in?

The administrative court rules on decisions; everything else, such as factual conduct, contracts with a public body and private-law acts like the sale of land, belongs to the civil court. If you did not use the objection and appeal route against a decision, the civil court treats that decision as lawful (formal legal force, formele rechtskracht). You cannot let the deadline pass and then sue for damages over the same decision.

What does the Awb say about enforcement, subsidies and damages?

Chapter 5 of the Awb contains the general rules on enforcement. Remedial sanctions end a breach: the order subject to administrative enforcement (last onder bestuursdwang, Article 5:21 Awb) and the order subject to a penalty payment (last onder dwangsom, Article 5:31d Awb). The প্রশাসনিক জরিমানা (Article 5:40 Awb) is punitive and comes with fair-trial safeguards, including the right to remain silent.

Title 4.2 regulates subsidies. A subsidy generally requires a statutory basis (Article 4:23 Awb), and the grant and the final determination are separate decisions; the determination can be set lower, with repayment of the difference.

Damage caused by an unlawful decision can be claimed from the administrative court up to €25,000 including interest (Article 8:89(2) Awb); above that amount the civil court is the main forum. For lawful government action that hits you disproportionately, Title 4.5 provides compensation for disproportionate loss (nadeelcompensatie).

What should you check when you receive a decision?

  • When was the decision sent? Count six weeks from the next day.
  • What does the closing paragraph say? It must state the remedy, the body and the deadline (Article 3:45 Awb).
  • Is it a besluit with legal effect, or a factual act or information letter?
  • Do you need interim relief because the decision takes effect immediately?
  • Have you requested the file? Authorities work in Dutch (Article 2:6 Awb), so plan for translation.

What should you check as a third party, such as a neighbour or competitor?

  • Is your own interest directly affected, or only indirectly through a contract?
  • Was the decision prepared with the public procedure, so that you must submit views on the draft within six weeks?
  • When was the decision published? Your deadline also runs from publication or notification.
  • Do you need interim relief to stop works or activities while your objection is pending?

What can we do for you with the General Administrative Law Act?

Our administrative lawyers act for companies and individuals in disputes with Dutch public authorities.

  • We assess within one working day whether a letter is a decision and what your deadline is.
  • We file a timely objection, if necessary first a short one to preserve your rights.
  • We send the notice of default and claim the penalty when an authority decides late.
  • We apply for interim relief to suspend a decision.
  • We conduct appeal and higher-appeal proceedings and claims for damages.

সারাংশ

  • The Awb governs how Dutch authorities decide; special statutes can deviate.
  • You can only object against a besluit, and only as an interested party.
  • Objection, appeal and higher appeal each have a six-week deadline.
  • An objection does not suspend a decision; interim relief does.
  • A late decision gives right to a penalty of up to €1,442 after a notice of default, except for IND decisions.

সচরাচর জিজ্ঞাস্য

একটি আপত্তি কি আমার আপত্তিকৃত সিদ্ধান্তকে স্থগিত করে?

No. An objection or appeal does not suspend the decision (Article 6:16 Awb). To hold it back, apply separately to the preliminary relief judge for interim relief (Article 8:81 Awb).

বেসলুইট এবং ফ্যাকচুয়াল অ্যাক্ট-এর মধ্যে পার্থক্য কী?

A besluit is a written decision of an administrative authority with a legal consequence (Article 1:3 Awb). A factual act, such as an inspector’s remark or an information letter, has no legal effect. Only a besluit can be challenged through objection and appeal.

আমি ছয় সপ্তাহের সময়সীমা পার করে ফেলেছি। আর কিছু বাকি আছে কি?

Possibly. A late objection is admissible only if you cannot reasonably be blamed for the delay (Article 6:11 Awb), for example due to documented illness or a missing statement of remedies. File at once with evidence.

আমি কি প্রথমে আপত্তি না জানিয়ে সরাসরি আদালতে যেতে পারি?

Only after the public preparatory procedure, or if the authority agrees to your request for direct appeal (Article 7:1a Awb). Otherwise the objection stage is compulsory.

How much is the penalty for a late decision?

After a written notice of default and two weeks, €23 per day for 14 days, €35 per day for the next 14 and €45 per day for the last 14 days: at most €1,442 (Article 4:17 Awb). It does not apply to IND decisions under the Aliens Act 2000.
